What options do restaurants, cafés, and other businesses have if they want to play music?

Starting July 1, 2026, the issue of music copyright in cafés, restaurants, hotels, and other businesses is receiving much more attention. In essence, if a business plays an artist’s music for customers—to create an atmosphere, encourage them to stay longer, or enhance the overall experience—it is no longer considered “personal listening.” Instead, it becomes the use of music for commercial purposes.

 

Simply put, playing music at home is different from playing music for an entire café or restaurant.

 

One point that many business owners misunderstand is that having a Spotify Premium, YouTube Premium, or Apple Music subscription does not automatically give them the right to play music publicly at a commercial venue. These subscriptions are generally intended for personal use. Once music becomes part of a business environment, copyright is a separate matter altogether.

 

So what options do cafés and restaurants have?

The first—and most straightforward—option is to pay the required copyright licensing fees and continue using artists’ music legally. This is the right choice for businesses that already have a well-defined musical identity, rely on familiar songs to create an emotional connection with customers, or want to build their atmosphere around playlists featuring popular tracks.

 

The second option is to use commercial background music platforms that provide proper licensing. Around the world, many cafés, hotels, spas, and gyms subscribe to business music services dedicated to commercial use instead of streaming music through personal accounts. The advantage is that owners can choose music based on mood, time of day, or brand identity while remaining compliant with copyright regulations.

 

The third option is to commission original music for the brand. A custom background soundtrack, exclusive playlists, or a unique sonic identity can help a business stand out instead of playing the same trending songs heard everywhere else. This approach is particularly suitable for café chains, restaurants, hotels, or brands that want to invest seriously in the customer experience.

 

The fourth option is to use AI-generated music, provided it comes with clear commercial licensing. This could become an attractive solution for smaller businesses looking for affordable background music that is highly customizable and carries fewer copyright risks. However, AI-generated music is not automatically copyright-free. Business owners should still carefully review the licensing terms, commercial usage rights, the source of the music, and any legal guarantees provided by the platform or music creator.

 

The fifth option is to use public domain music or Creative Commons music that permits commercial use. This can help reduce costs, but only if the licensing terms are properly understood. Some licenses allow free use but require attribution; others prohibit commercial use; and some do not allow modifications. Using music under the wrong license can still result in copyright issues.

 

And finally, there is one option that is worth serious consideration:

 

Some venues could instead embrace natural ambient sounds—the sound of coffee being brewed, quiet conversations, flowing water, the wind, an open kitchen, or simply better acoustic design to create a comfortable atmosphere. In some cases, silence itself can become a venue’s signature feature.

 

In this sense, music copyright is not simply another operating expense. It also prompts business owners to rethink the role that music plays in the overall customer experience.

 

What music should be played? When should it be played? Who is it for? Do businesses really need chart-topping hits, or do they simply need an atmosphere with the right sound?

 

From July 1, 2026, cafés and restaurants may have to think more carefully about these questions. But this also presents an opportunity for the F&B industry to become more professional—to respect copyright more fully, develop stronger sonic branding, and rely less on the same familiar playlists that sound identical everywhere.

 

In other words, even if businesses can no longer play music “for free” as they once did, they still have plenty of alternatives. The real question is which option is both legal, affordable, and true to the spirit of the brand.
